PLEASE READ CAREFULLY, AS THESE TERMS & CONDITIONS FORM THE BASIS ON WHICH WE PROVIDE A SERVICE FOR YOU.

1. What information do we collect about you?

 If you request a specific service from us by submitting an enquiry we may ask you to submit information such as your name, email address, postal address and telephone number/s.

We do not automatically capture or store other personal information relating to visitors to this site other than to log IP addresses, the unique address which identifies your computer on the Internet, which is automatically recognised by our web server. We do not use cookies on this site.

2. How do we use your information?

The information & card details for payment we take about you is used only by us to process collection/delivery details, to generate average statistics about our site visitors, to improve the content of our web pages, to administer this site and to send you any information you have requested. Payment details are not stored but securely shredded after use, unless you request that we keep them on file to use at a future date.

3. Verification

All collections and deliveries need to be ultimately confirmed via email, even if in the first instance contact was made by telephone. We will need names, addresses, post codes and a contact telephone number for both parties. We will then email back with confirmation that you are in the schedule for the specified date of collection and also a delivery date. Fish come first, other species second and standing items are last to be delivered.

4. Packaging

All live goods are to be packaged accordingly, with names addresses and telephone numbers written clearly on each box. JM Livefish & Aquaria Couriers Ltd reserve the right not to take any improperly packaged goods and will charge half the courier fee for attending, if the right packaging is not available. 

Please make sure all live goods we can gain access to, for the purpose of providing water, food and to be able to check on them at any given time.

Snakes over 10 feet in length need to be in properly secured plastic containers with air holes, inside snake bags or duvets, which we will then attach ratchet straps around the container, for added safety and security.

5. DOA's

We accept no responsibility for dead on arrival fish or live goods unless  due to van breakdown or accident. JM livefish & Aquaria Couriers Ltd hold insurance for live goods in transit and will make a claim against loss, if said claim is valid.  

All boxes will be sealed and marked with an address, prior to our undertaking to transport them. We will have no issue to enter a sealed box unless there is evidence of leakage in boxes containing live fish ( or damage which has occurred before collection) where we will undertake the necessary steps to remedy the situation.

 We will take digital photographs of damage that is seen, which remain our property but which the seller and buyer will have access to, if there should arise a dispute over a DOA.

 Most deliveries are Sameday or Nexday, apart from Scotland which may involve an overnight and delivery within 48 hours. However, such times as adverse weather conditions, road traffic accidents, breakdowns, re-scheduling on route and other causes may intervene. JM Livefish & Aquaria Couriers Ltd will do everything possible in letting the customer know what is happening and will try to resolve such issues as quickly as possible. We will continue to deliver after midnight, as long as there are live goods on board and the customer is willing to wait up for delivery. Otherwise, delivery will take place as soon as possible the next day.

JM Livefish & Aquaria Couriers  Ltd cannot be held liable for dead stock, cracked or broken tanks, or equipment that does not work, after we have left the premises, or within a few days of us leaving the premises. If the customer does not wish to check the poly box/basket/container/tank,  equipment etc in our presence after delivery has taken place, to verify the condition of the live goods or standing items, we are unable to verify if a DOA, or damage to tanks or equipment  has taken place before, during or after,  said delivery was made. 

IT IS IN THE SELLERS, OURS AND THE BUYERS BEST INTERESTS, TO CHECK THE BOX,  BASKET, CONTAINER, TANKS OR EQUIPMENT, IN OUR PRESENCE, UPON DELIVERY.

6. Weather conditions 

At times, adverse weather conditions in the areas we are collecting/ delivering to, may prohibit or delay delivery. The "sender"  and/or the "receiver" will be advised by us if we think the collection/delivery can still take place, or may be delayed. We will do all we can to make sure that the areas being collected from and delivered to, are not overly affected by adverse weather conditions such as snow, or flooding, prior to collection/delivery. We reserve the right to alter or re-schedule live goods and aquaria, if we have reason to believe that we would not be able to make either a delivery or a collection due to adverse weather conditions. If the "sender" or "receiver" still wish collection/delivery to take place, we will endeavour to do so and will require written permission via email but JM Livefish & Aquaria Couriers Ltd cannot be held accountable, if adverse weather conditions affect the live goods or they become DOA's

7. Payment & Accounts

All bookings  are C.O.D (Cash on Delivery)unless a prior agreement for an account has been arranged by both parties, in which case an Invoice will be issued at the end of each month, to be paid within 7 days.

Accounts are available after one months trading whereby JM Livefish & Aquaria Couriers Ltd are paid for the work they do at the end of the first month. The second months work will be on Account and an invoice will be sent out at the end of each month thereafter, with 7 days notice to make payment.

Cheques accepted though please be aware that returned cheques will be subject to immediate payment via an alternative method and will incur a £10.00 charge to cover banking and admin costs. They also need time to clear before we undertake any collection or delivery.

8. Customer Requests

From time to time, occasions arise where JM Livefish & Aquaria Couriers Ltd are asked to  catch  and/or pack the fish themselves. We will endeavour to follow your wishes but reserve the right not to carry any live goods  of dubious health.

We  charge £15 for the use of our own polybox/bags and the catch & pack service, or £10 for the catch & pack service on its own, if a polybox is available from the seller.

On occasion, JM Livefish & Aquaria Couriers Ltd has been asked to disassemble, transport and reassemble tanks and livestock. Please note that any deaths or damage that occurs after we have left the items in your care, we are not accountable for.

All advice is given freely. It is up to you the customer, whether you follow that advice or not!

9. Returns

There may be occasion when delivery cannot take place at the given address because the buyer is not at home. In these circumstances the seller will be contacted and with their permission, we will attempt delivery of the goods to a neighbour, workplace, or similar. This will incur a "time" penalty of £10 as inevitably, this causes a knock on effect with other deliveries, some of which we have had to rearrange in the past at our own cost. The "time" penalty will be paid for by the buyer.

If delivery cannot take place, or the buyer wishes to return the goods because it is not what the buyer was expecting, we will attempt contact with the seller to inform them of the buyers wishes to return the goods. If JM Livefish & Aquaria Couriers Ltd have to return the goods, this will incur a return delivery fee of the original price paid, to be paid for by the seller.

If the seller does not wish the return of the goods, we will leave the items with the buyer as this is a problem to be resolved between the buyer and the seller, not JM Livefish & Aquaria Couriers Ltd.

10. Delivery times

We cannot do collection or delivery times based on previous experience. Bookings come in all the time and the schedule alters on a daily basis.

We also get customer requests while on route that can throw the schedule timing out, by as much as hours. 

Suffice to say, if JM Livefish & Aquaria Couriers Ltd make arrangements to collect and deliver on a certain day/date, then that will go ahead unless we have cause to ring you to alter arrangements or to inform you of severe delays. Some things may occur in which we have no time to ring any customers, for instance while travelling overnight or an early morning (from 5am)

JM Livefish & Aquaria Couriers reserves the right to withdraw, alter, or reschedule, any collections or deliveries on any date or time, i.e for Health and Safety reasons, sickness, staff shortage, van breakdown,  insufficient load etc, although we would endeavour to give as much notice of this as possible and try to reschedule a different collection and delivery date.

All sellers and buyers will be contacted on the date of collection,  from the last delivery postcode, or at least when we are one hour away. This ensures that the live goods spends as little time boxed up as possible.

We can only follow the sat nav and know the time of the next collection/delivery but cannot foresee times hundreds of miles up the road. We can give approx estimates of morning, afternoon or evening but it will be just that, an estimate. We have tried schedules in the past but over the miles we do, its is just impossible to adhere to! Please remember we are a multi-drop company and whilst ever care and consideration is taken with your live goods, with water, food, warmth or air conditioning, as the need arises, there is always going to be someone first on the list, middle of the list and last on the list.

If you would prefer a weekend collection instead of taking a day off work, we also do weekend and Bank Holidays, at no extra cost.

11. Point to point

JM Livefish & Aquaria Couriers Ltd undertake to provide a service known formally as Point 2 Point. For this service, we would  drive to the collection address and straight on to the delivery address with no other cause for stoppage. JM Livefish & Aquaria Couriers Ltd guarantee same day delivery 12 hours England or Wales. 18 hours for Scotland, or a total refund if this is not accomplished.

12. Amendments to T's and C's

JM Livefish & Aquaria Couriers Ltd reserve the right to amend these Terms and Conditions as and when, the need arises.
